An inherent risk of exposure to COVID-19 exists in any place where people gather. COVID-19 is an extremely contagious disease that can lead to severe illness and death. You and all minors accompanying you to the event (collectively, “All Attendees”) acknowledge and voluntarily assume all risks, hazards, and dangers arising from or relating in any way to the risk of contracting a communicable disease or illness—including, without limitation, exposure to COVID-19 or any other bacteria, virus, or other pathogen capable of causing a communicable disease or illness, whether that exposure occurs before, during, or after the event, and regardless of how caused or contracted—and All Attendees hereby waive any and all claims and potential claims, now known or hereafter known, against Stern Grove Festival (for purposes of this Release of Liability, including its directors, employees, agents, and other representatives), relating to such risks, hazards, and dangers—including derivative claims and  those arising out of the negligence of Stern Grove Festival.  You further acknowledge that you have read and understand Section 1542 of the California Civil Code which reads as follows: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”  You hereby expressly waive and relinquish all rights and benefits under that section. 

All Attendees also promise not to make or bring any such claim against Stern Grove Festival, and forever release and discharge Stern Grove Festival from liability under such claims.  If you violate this covenant, you agree to pay all costs and fees, including attorney’s fees, that Stern Grove Festival incurs arising out of your violation of this covenant. 

This Release of Liability is intended to be as broad and inclusive as is permitted by law.  If any part of this Release of Liability is held to be invalid or legally unenforceable for any reason, the remainder of this provision and contract shall not be affected thereby and shall remain valid and fully enforceable.
